How to Fight Your Case If Injured by a Trailer Malfunction

Truckers and other CDL drivers help keep the world in motion. This is especially true since consumer demand continues to grow and change. CDL drivers aid in keeping store shelves stocked and delivering products to people’s homes and businesses. They also operate heavy machinery for construction and renovation projects. Those tasks barely scratch the surface. Still, the trucking industry has its fair share of dangers for drivers as well as others on the roads and job sites. Many things can go wrong with an 18-wheeler and various other types of heavy equipment, not the least of which are trailer malfunctions.

Measures to Take after an Injury Caused by a Trailer Malfunction

Taking the right steps after someone is injured by a trailer malfunction will help improve the victims’ chances of receiving the compensation they’re entitled to. It can also go a long way toward mitigating resulting injuries and even saving people’s lives in some instances. If someone else is injured as a result of a trailer malfunction, be sure to do what you can to help. If you or other victims are unable to take action, enlist someone else to do so.

Seeking Medical Attention

First, don’t hesitate to get first responders en route to help when someone is injured due to a trailer malfunction. These injuries can be particularly extensive, and many are life-threatening. Every delay in seeking medical attention can lead to worsening injuries and increase the risk of death after an accident. Keep in mind that, even if no one appears to be injured, some problems can remain hidden for hours or even days before making themselves known. That’s why it’s essential to allow first responders to check everyone involved.

Filing Police Reports

When emergency medical personnel are contacted, other authorities are generally sent to the scene of the accident as well. This includes law enforcement officials. It’s important to file police reports following an accident to create a record of the incident. The report will contain valuable information that can shed light on what caused the accident and how it may have contributed to any resulting injuries. You’ll also need a police report to file an insurance claim among other actions.

Contacting an Attorney

After police reports have been created and medical care has been received, it’s time to contact a personal injury attorney. Those responsible for these types of accidents and their insurance companies aren’t always willing to approve claims for victims’ injuries and losses. Because of that, an attorney can help ensure justice is served. Attorneys also aid in getting the proper amount of compensation for victims’ injuries, missed time from work, and other damages. It’s best to avoid trying to fight the insurance companies and the people responsible for such accidents alone.

Considering Your Best Interests

Trailer malfunctions can stem from several causes. Improperly maintained equipment, substandard mechanic work, and faulty parts are only a few of them. Operator error often comes into play as well, including improper training, speeding, and distracted driving. Whether you were injured while operating a trailer or while simply being near one, be sure to take the necessary measures after the fact. Seek medical attention, file a police report, and contact a personal injury attorney. Each of those steps plays a critical role in the overall outcome of an accident.
