On Monday, July 1, 2024, the United States Supreme Court handed down one of its most substantial rulings yet. With six justices in favor of the ruling, the nation’s highest court determined former Presidents, including Donald Trump, cannot be prosecuted for actions directly connected to their responsibilities as President.
“Under our constitutional structure of separated powers, the nature of presidential power entitles a former president to absolute immunity from criminal prosecution for actions within his conclusive and preclusive constitutional authority,” U.S. Supreme Court Chief Justice John Roberts wrote.
“And he is entitled to at least presumptive immunity from prosecution for all his official acts. There is no immunity for unofficial acts.”
It is unclear how this will impact his most recent trial in New York, but it nearly eliminates the possibility for the Fulton County District Attorney to move forward with their election interference case against Trump before Election Day.
“Today’s decision to grant former Presidents criminal immunity reshapes the institution of the Presidency,” U.S. Supreme Court Justice Sonia Sotomayor wrote in dissent.
Sotomayor’s disapproval has been countered by Trump’s celebratory Truth Social posts and comments from Kevin Roberts of The Heritage Foundation, a right-wing think best known for putting together Project 2025.
“In spite of all this nonsense from the left, we are going to win. We’re in the process of taking this country back. No one in the audience should be despairing,” Robert said during an episode of War Room.
“And so I come full circle on this response and just want to encourage you with some substance that we are in the process of the second American Revolution, which will remain bloodless if the left allows it to be.”
Roberts’ comments were met with strong reactions throughout social media.
“The leader of Trump’s project 2025 plan just made a chilling threat,” New York University student and TikTok influencer Harry Sisson wrote.
“Our Project 2025 warnings are not hyperbole,” Independent Columnist Ahmed Baba chimed in.
“Let this comment above from team trump sink in and then please stop talking about the fucking debate. Our rights to live freely and safely in America with a democracy supported by laws continues with President Biden only. I will vote for Pesiden[t] Biden because I love America! It is the ultimate act of patriotism to vote for President Biden,” added Fred Guttenberg, father of a Jaime Guttenberg, a student killed during the Parkland, Florida mass shooting of 2018.
