
Judge Aileen Cannon of the United States District Court for the Southern District of Florida has dismissed the United States of America’s lawsuit against former President Donald. Cannon elected to dismiss the lawsuit after determining U.S. Special Counsel Jack Smith’s appointment was unconstitutional.
“The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution,” Cannon wrote, according to ABC News.
The lawsuit levied against the presumptive Republican nominee dates back to more than a year. In early 2023, agents from the Federal Bureau of Investigation (FBI) raided the home of Donald Trump in Mar-a-Lago, Florida. Months later, it was revealed that FBI agents found at least four documents marked “classified” in his personal bedroom.
“Notably, no excuse is provided as to how the former president could miss the classified-marked documents found in his own bedroom at Mar-a-Lago,” U.S. District Judge Beryl Howell wrote.
During the first week of June in 2023, the former President, his aide Waltine Nauta and property manager Carlo De Olivera were hit with a 37 felony count indictment tied to the handling of classified documents after Trump’s time in office. Days later, U.S. Special Counsel Jack Smith tacked on three additional felony counts. From August 4 through August 15, Trump, Nauta and De Olivera each filed not guilty pleas.
